P3/M2 - LO2 - Legal, Moral, and Ethical Issues

Legal, Moral, and Ethical Issues


When creating media products, there are multiple concerns that I will need to acknowledge:

LEGAL ISSUES:
When producing my idents I must consider the legal requirements so that there is no issue that could interrupt the process. 

MORAL AND ETHICAL ISSUES:
Ethical issues are situations based on moral conflict in society. Moral issues is the personal perspective for the values of the moral conflict.

When filming my idents, I must consider the following:

IDENT 1:

LEGAL ISSUES - An issue I must consider is the Copyright Designs and Patents Act (1988). During post-production I will make sure to look at music and sound effects that are copyright-free; in order to not get any legal action put against me.

MORAL AND ETHICAL ISSUES - When filming my ident, I must consider the concerns of treating my actor right. As this actor is an animal, I will be careful not to mistreat him and make sure he is not stressed out when performing for the camera.


IDENT 2:

LEGAL ISSUES - An issue I must consider when producing the ident is the 'Freedom Of Information Act'. I have chosen this specific act as I am using actors aged under-18. I must make sure to gain written consent from the guardian of the actor, in order to go ahead with successfully filming the ident.

MORAL AND ETHICAL ISSUES - Another issue that I must reflect is 'Stereotyping'. As my second ident is using an actor from a Pakistani background, I must be sensitive with the way he is portrayed to the camera; in order to not offend anyone.


OFCOM:

Ofcom is the regulator for the communications service in the UK. They are responsible in doing various tasks; but specifically to relate to this work, they oversee TV channels and radio. TV and radio programmes must follow the guidelines presented on the Ofcom website. This is to prevent any harmful content from being exposed to the audience. 


Here are a few features from Ofcom that may affect both of my idents:

  • Protection of under-18`s
  • Copyright
  • Stereotypes

SECTION 1: Protecting the Under-Eighteens

This code outlines the rules of protecting the under-18`s; whether they`re the audience or featured in the ident.

I must make sure that every detail shown in the idents are suitable to be shown for the target audience.

I will have both older and younger audiences view the draft product to make sure it's all appropriate.

SECTION 2: Harm and offence

This code ensures that the material included in the ident are not harmful or offensive for the viewers.

I must make sure that ‘the time of the broadcast’ is up to standard.

I will double check the conditions of the scenes of the idents (when filming and after), to make sure everything is suitable.

SECTION 7: Fairness

This code guarantees that the broadcasters avoid mistreatment towards the crew in the programmes.

I must make sure that everyone involved in the production of the filming are validated and treated fairly.

Due to the actors being under-18, I will keep contact with the guardians for consent with certain decisions.

Copyright (Requirement, owner, clearance, cost)

Copyright is an intellectual property that protects the creator`s original works from being stolen/uncredited.

There could be legal action made against me for using copyrighted audio or imagery.

I will make sure to do research on the potential features I may add in, to make sure they are copyright-free or I am able to credit the original owners.

Royalties

Royalties is a sum paid to a creator for the use of a copy of a piece of work.

I will pay the author for a piece of their work.

For me to solve this problem, I shall pay the owner for the product; but ensure that I try and negotiate for the lowest price as I am a student.

Misrepresentation

Misinterpretation is the action of interpreting something wrongly.

My first ident may not show explicit elements of what represents CBBC.

To ensure that the ident is not misrepresented with the message, I will show a collective audience and gain feedback to see how to improve.
